Colorado Foreign Subpoena Domestication and Service of Process
To domesticate a subpoena in a case being litigated in any U.S. state other than Colorado (referred to as a “foreign” state) the request for issuance of subpoena together with the required documents must be filed with the Clerk of the District Court in the county where the discovery is sought to be conducted in Colorado.
(1) Foreign Subpoena issued from the home state and jurisdiction.
(2) Colorado Form JDF 87 Request to Issue Subpoena/Subpoena Duces Tecum Outside the State of Colorado
(3) Colorado Form JDF 90 Subpoena to Appear for Deposition or Produce
(4) Filing fee in the amount of $235 payable to the Court.
